1) CALL 911 AND GET THE POLICE THERE IMMEDIATELY

The other person might try to leave the scene, or to come to some type of agreement.  Try to prevent that from happening. Even if you don’t feel hurt, get the police and paramedics there right away.  

Be careful what you say and what you sign. After an accident, you may not be in in the right frame of mind to be making decisions, and you may say or sign something you regret later.   You are going to get asked questions by the police – tell them exactly as you remember it, don’t “over describe.” Just the facts.  And whatever you do, don’t apologize or admit guilt; this could hurt your case later.  

2) TAKE LOTS OF PHOTOS AND GET AS MUCH INFORMATION AS YOU CAN

Take pictures of all damage to your vehicle and any property, as well as any visible injuries. Document everything you can, including:

  • obtain names, addresses, and phone numbers of any witnesses

  • obtain names of the police officers who responded to the accident

  • photograph the location of the vehicles and the damage

  • photograph skid marks or other evidence, if available

  • record the exact location and time of day

  • note the weather and road conditions, traffic signs, and other relevant information

  • note the names of anyone who claims responsibility for the accident
